MCIVOR HILL LIMITED (“the Company”, “we”, “our”)

Purchaser of any MCIVOR HILL LIMITED products or services, (“You”)
AGREEMENT TO PURCHASE
- The Company will provide clothing and homewares products through their e-store and over email.
- When you place an order over email, or complete checkout, this is considered an offer to purchase the products.
- Once submitted, The Company will confirm acceptance of your offer to purchase. Once the offer is accepted the order can no longer be cancelled or amended.
PRICING
- We will list prices against each item. Pricing is subject to change at any time at our sole discretion.
- All prices are inclusive of GST and listed in New Zealand Dollars.
- All sales, discounts or promotions are at our sole discretion and unless explicitly provided in writing there shall be no rain checks or retrospective application of discounts.
PREPAYMENT REQUIRED
- Upon you placing the order with the Company, full prepayment of the items is required. No order shall be progressed until it has been paid for in full.
- When you complete payment via our website and pay by credit card, you agree to having the payment processed by a third party provider.
ACCURACY OF PRODUCT DESCRIPTIONS
- the Company will use best endeavours to ensure all products are displayed accurately but variations can occur for a variety of reasons. Woollen products are woven on an individual basis so some discrepancies are to be expected. If the product delivered objectively is significantly varied from the product displayed on the website then you can return the unworn item to the Company for a full refund. All returned items under this clause must comply with our full returns terms.
ACCURACY OF PRODUCT AVAILABILITY
- Due to the nature of internet sales it is possible that some products may be displayed available which are no longer available for purchase. If this occurs the Company will provide you with an option for a full refund, credit or a suitable replacement product available at the same price point.
- Ownership (title) to the products supplied by the Company for will pass to you at the time the product leaves our warehouse/is shipped to you.
RETURNS
- You are entitled to return the item where it is faulty or damaged on arrival. You are also entitled to return the item where it does not match the description on our website.
- To start a return, you should contact us via email. We will confirm if we require any further information and if your return request is accepted.
- All goods returned must be in new condition. It must not be worn or washed and must be returned in its original packaging with tags (if any) attached.
- A return request must be received by email within 20 days of delivery.
- Please not we do not process exchanges. If you have purchased the wrong colour or size please contact us and we will, in our sole discretion, decide whether to accept a return. Upon receipt of the returned item we would provide a full refund. It is encouraged to place your new order for the alternative size or colour as soon as your return is accepted to ensure the item is secured for you.
- All return shipping costs are the sole obligation of the Purchaser and remain at the purchaser’s risk until returned to our premises. As such, it is recommended you arrange for postal tracking of your return.
- Upon receipt of all goods returned to our premises, we will inspect the item. Any signs that the item has been worn, such as stretching, damage, pet hair or scents will deem your return invalid and we will not be required to refund your purchase price. You will be contacted and advised and you can either pay $10 for a reshipping charge (within NZ), or you can surrender the item to us and we will donate the item to a charitable organisation on your behalf, and if none are willing to accept the item it will be destroyed.
- Refunds will always be made through your original payment method.
- 20. Unfortunately, we cannot accept returns on sale items and gift vouchers.
SHIPPING
- Our shipping and freight costs will be listed on the website at the time of checkout.
- We reserve the right to change shipping providers from time to time. Within New Zealand our standard shipping time is approximately 10 working days. This timeframe is out of our control and from time to time delays are to be expected. Within New Zealand our current shipping timeframe is 10 working days.
- We reserve the right to hold or pause any order for suspected fraud.
- We will only refund shipping where the item is faulty, or we have sent you the wrong order.
- For orders outside of New Zealand, shipping will be an additional charge. All taxes, duties and additional import associated fees are payable by you, the Purchaser.
WARRANTY – DELICATE ITEMS
- You acknowledge that our products are delicate and require careful handwashing. Due to the delicate nature of our products we require you to carefully inspect your product on delivery and if there are any faults to immediately notify us with photos of the damage. Where we suspect in our sole discretion that the item has been damaged due to wearing the garment or rough handling we are entitled to refuse to provide a remedy.
GENERAL TERMS
- We have no liability to you for being unable to perform our obligations under this agreement or due to website failure if the cause of the inability to perform is beyond our reasonable control.
- Subject to the Company’s obligations under law, such as the consumer guarantees act, the Company shall only ever be liable to you to the purchase price of your products. This remedy shall be your sole and exclusive remedy and our entire obligation and liability for any breach of this agreement or limited warranty will be the actual amount paid by you for the product. Under no circumstances will the Company be liable for any consequential, incidental, special or punitive damages or losses whether direct or indirect.
- We will comply with all our obligations under the Fair Trading Act 1986 and Consumer Guarantees Act 1993, nothing in these Terms is intended to limit any of the rights or remedies that you are entitled to under those acts. If you acquire our products for a business purpose and are considered ‘in trade’, you agree that all guarantees provided by the Consumer Guarantees Act 1993 are excluded to the full extent permitted by the law of New Zealand.
- The governing law of these terms is New Zealand and any dispute arising from these terms shall be heard by the courts of New Zealand.
- You will pay all the Company’s expenses arising from any breach by you of this agreement including but not limited to debt collection.
- This agreement can only be amended by written agreement of the Company and the Client.
- Notices are permitted by email to the email addresses noted for the Company.
